Dieselogic.com Limited Warranty

IF YOU, THE CUSTOMER, DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS LIMITED WARRANTY, SEND THE UNUSED PRODUCTS IN THE ORIGINAL PACKAGING BACK TO US, DIESELOGIC.COM, IN ACCORDANCE WITH THE TERMS AND CONDITIONS OF OUR RETURN POLICY.

What Does this Limited Warranty Cover?
This limited warranty (this “Limited Warranty”) covers any defects in manufacture and/or materials in injector products (collectively, the “Product” or “Products”) purchased directly from L & J Diesel Service, Inc. d/b/a Dieselogic.com, a Florida corporation (“Dieselogic.com”).

What Does this Limited Warranty Not Cover?
This Limited Warranty does not cover damage to Products caused by contaminated fuel, improper installation, or any other outside influence or third party. Disassembling or tampering with the Products voids this Limited Warranty.

What is the Limited Warranty Period of Coverage?
Effective 09/21/2022, select new & remanufactured injectors, pumps, and turbos carry a two (2) year limited warranty, balance carries a one (1) year limited warranty from the original invoice date (the “Limited Warranty Period”). All parts purchased prior to 09/21/2022 carry a one (1) year limited warranty from the original invoice date.This Limited Warranty is non-transferable and is valid only for the original purchaser of the Products. 

What Will Dieselogic.com Do to Correct The Problem?
If during the Limited Warranty Period any Product fails to function as designed (not as a result of outside damage, contamination, improper installation, or misapplication) as determined by our testing, Dieselogic.com, at its option, will repair or replace the defective or malfunctioning component of the Product at no charge. Using the instructions below, you will need to send the Products back to Dieselogic.com, at your expense, during the Limited Warranty Period for testing and warranty consideration. If our testing confirms that any Product does not exhibit any manufacturing defect within the manufacturer’s specifications we have identified, you will be assessed a fee for cleaning / testing and the Product(s) will be sent back to you at your expense. The cleaning and testing fee for non-warrantable parts shall be no less than $45 per injector or $400 per high pressure pump.

What Will Dieselogic.com Not Do?
No refunds, exchanges or returns are given on Products sent to Dieselogic.com under a warranty claim. We do not offer refunds, exchanges or returns on Products that have been installed. Dieselogic.com assumes no liability for the improper installation, improper Product selection, or misapplication of the Products. You are responsible for having your installer install the Products correctly. If in doubt, you should contact the specific Product manufacturer directly before installing the Products. Under no circumstances shall Dieselogic.com be liable for any expenses you may incur related to the Products, including, but not limited to, labor or installation charges, down time, towing, travel, lodging or other expenses incurred in diagnosis of any claimed defect (such as third party testing), removal or reinstallation of the Product, or any other contingent expenses you may incur.

How Do You Get Service?
All warranty claims are subject to prior approval by Dieselogic.com. To be eligible for warranty service you must first email us at rma@dieselogic.com. We will provide you with a Warranty Claim Request Form which must be completed and returned to us before any warranty claim will be initiated. Once we receive your completed Warranty Claim Request Form, we will provide you with a Return Merchandise Authorization (“RMA”) number and written instructions for sending the Products to us for evaluation. We do not accept Products sent to us without a completed Warranty Claim Request Form and RMA. You are responsible for all costs associated with shipping the Products to us. Depending on the results of our testing, you may need to pay for us to ship the Products back to you. Dieselogic.com shall not be responsible for any damages caused by shipping.
We do not store the Products you voluntarily send to us for testing indefinitely.  It is the original purchaser’s responsibility to communicate with us regarding the results of the testing and to pay any testing fees owed for the Products. We will hold the Products for ninety (90) calendar days from the date we receive the Products from you (the “Holding Period”) and will use commercially reasonable efforts to communicate with you (using the phone number and e-mail address you provided at the time of your purchase and/or at the time the RMA is issued regarding the Products) the testing results and if there are any fees owed.  If we do not hear from you and/or any applicable fees remain unpaid at the conclusion of the Holding Period, we will deem all of the Products you sent to us to have been intentionally abandoned by you (the “Abandoned Property”) and we reserve the right to dispose of, use, reuse and/or resell the Abandoned Property in our sole discretion.

Limitations of this Limited Warranty
The Products are provided on an “AS IS” with all faults basis and with no warranty except the Limited Warranty set forth above. To the maximum extent permissible by law, Dieselogic.com does not warrant that the Products are of merchantable quality or that they can be used for any particular purpose. These are considered implied warranties. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. If a limitation on implied warranties is not permitted in your state, the implied warranties shall be limited to the term of the Limited Warranty Period provided above.
This Limited Warranty sets forth your exclusive remedies with respect to the Products covered by it. No attempt to alter, modify, or amend this Limited Warranty shall be permitted. Under no circumstances shall Dieselogic.com, its directors, shareholders, officers, agents, employees, contractors, successors or assigns be liable for any injuries or damages whatsoever to any person or property arising from the installation or use of the Products, which shall include, but not be limited to, consequential, incidental, special, exemplary or punitive damages. To the maximum extent permissible by law, Dieselogic.com’s liability in all events is limited to, and shall not exceed, the purchase price paid for any Product that gives rise to any liability. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

How Does State Law Relate to this Limited Warranty?
This Limited Warranty gives you specific legal rights, and you may also have other rights which vary from state to state. By agreeing to the terms of this Limited Warranty, you, the Customer, agree that the venue for any litigation, legal action or other proceeding arising out of or relating to this Limited Warranty shall lie solely in the federal or state courts located in Duval County, Florida. You, the Customer, hereby (i) consent to personal jurisdiction and venue in such courts, (ii) agree that such courts shall have exclusive jurisdiction over any matters arising out of or related to this Limited Warranty, (iii) acknowledge and agree to accept service of process by registered or certified mail or the equivalent directed to your last known address as determined by Dieselogic.com or by whatever other means are permitted by such courts, and (iv) waive all claims to the effect that any of the aforementioned courts constitutes and inconvenient forum.
